Green Earth Building Contractors – Terms and Conditions

1. Definitions

  • “Company” means Green Earth Building Contractors.

  • “Client” means the person or entity who accepts a quotation from the Company.

  • “Services” means the building, construction, and associated services provided by the Company.

  • “Contract” means the agreement between the Client and the Company for the Services.

2. Quotations

  • All quotations are valid for 30 days from the date of issue unless otherwise stated.

  • Quotations are based on information provided by the Client. Any changes to the scope of work may result in additional charges.

3. Payment Terms

  • A deposit (typically 10%-30%) is required upon acceptance of the quotation.

  • Interim payments may be requested for longer projects, as detailed in the quotation.

  • Final payment is due within 7 days of project completion unless otherwise agreed in writing.

  • The Company reserves the right to charge interest on overdue invoices at a rate of 5% per month.

4. Variations

  • Any variations to the agreed work must be confirmed in writing and may incur additional costs.

  • The Company will not proceed with variations without the Client’s written consent.

5. Access and Site Conditions

  • The Client shall provide suitable access to the site and ensure it is free of hazards.

  • The Client must obtain all necessary permissions (e.g., planning permission) unless otherwise agreed.

  • The Company will take reasonable care to avoid damage but is not responsible for any unavoidable damage to surrounding areas.

6. Materials and Products

  • Materials remain the property of the Company until paid for in full.

  • Where the Client provides materials, the Company accepts no liability for defects or failures caused by such materials.

7. Delays and Force Majeure

  • The Company will not be liable for delays caused by weather, unforeseen circumstances, material shortages, strikes, or events beyond its control.

  • In such cases, reasonable adjustments to project timelines and costs may apply.

8. Workmanship Guarantee

  • The Company guarantees its workmanship for 12 months from the completion date, unless otherwise specified.

  • This guarantee does not cover damage caused by misuse, neglect, or external factors beyond the Company’s control.

9. Insurance

  • The Company holds appropriate public liability insurance.

  • It is the Client’s responsibility to ensure appropriate insurance is in place for the works, particularly if the property is unoccupied.

10. Termination

  • Either party may terminate the Contract by giving 14 days’ written notice.

  • The Client must pay for all work completed and materials ordered up to the date of termination.

11. Dispute Resolution

  • In the event of a dispute, both parties agree to attempt to resolve matters amicably before pursuing legal action.

  • If necessary, disputes will be settled in accordance with the laws of England and Wales.

12. General

  • The Company may subcontract elements of the work but remains responsible for the quality of the subcontractors’ work.

  • These Terms and Conditions apply to all contracts unless otherwise agreed in writing.

  • A quotation does not constitute a contract until the Client’s acceptance is received and confirmed in writing by the Company.

  • Any changes to the original quotation may require additional charges.

3. Scope of Work

  • Work will be carried out according to the agreed quotation/specification.

  • Any variations must be agreed in writing and may affect costs and completion dates.

4. Payment Terms

  • Progress payments will be invoiced according to the agreed schedule or at key stages of the project.

  • We are not liable for delays caused by weather, supplier shortages, unforeseen circumstances, or matters beyond our control.

  • Any extension of time required will be communicated as soon as possible.

7. Materials

  • All materials supplied will be new and of good quality unless otherwise specified.

  • Materials remain the property of the Company until full payment is received.

8. Health and Safety

  • The Company will comply with all relevant health and safety legislation.

  • The Client must inform the Company of any known hazards on site.

9. Warranty

  • Workmanship is guaranteed for [insert period, e.g., 12 months] from the date of completion.

  • Manufacturer warranties for materials will be passed to the Client where applicable.

  • Warranty excludes damage caused by misuse, neglect, or external factors beyond the Company’s control.

10. Insurance

  • The Company holds appropriate Public Liability and Employers’ Liability insurance.

  • It is the Client’s responsibility to ensure the site is adequately insured during the course of the works.

11. Cancellation

  • Cancellation by the Client after work has commenced may result in charges for work completed, materials ordered, and other reasonable costs.

  • In the event of cancellation before work commences, a cancellation fee may apply.

12. Limitations of Liability

  • Our liability is limited to the value of the contract.

  • We are not liable for any indirect or consequential losses arising from delays, defects, or performance.

13. Governing Law

  • These Terms and Conditions shall be governed by and interpreted in accordance with the laws of [England and Wales / relevant jurisdiction].
